The regular meeting of the Town of Hartland, County of Niagara, State of New York, was held on the above date at the Town Hall, 8942 Ridge Road, Gasport convening at 7:30 p.m.

Supervisor Annable called the meeting to order with all present standing for the pledge to the flag.

Superintendent Hurtgam reported the cost for the Tire drop off will be higher this year; however we will continue to use Modern Disposal.  Supervisor Annable said that the Town will contract with SunnKing for an ongoing, onsite recycle program.  The program will run one day a month at the Highway garage.  There will be a cost of $5-10 for broken televisions, most everything will be dropped off without a charge.  SunnKing will pick up when 10 totes have been filled.

NEW BUSINESS:

Supervisor Annable has spoken to both Dog Control Officers about a new schedule of duties and the compensation for those duties.  Currently Barbara Turrell is our primary DCO and earns an annual salary; Joel Winters is our part-time DCO, filling in when necessary.  The new agreement would alternate the duty of primary DCO on an every other month schedule with a pay scale of $300.00 per month, plus mileage.  There will no longer be an hourly rate and if the DCO is not in town or is unable to do the job, then the other person would fill in.  Each DCO will prepare a report, which will be given to the Town Clerk.

Adjustment to Dog Control Officer Pay Scale

RESOLUTION 78-2015

MOTION by Councilman Snyder, seconded by Councilman Gross to adjust DCO pay to $300.00 per month on an alternating schedule.

Supervisor Annable introduced the Countywide Government Efficiency Plan and the how the Town of Hartland will participate.  Niagara County will act as the reporting agency, all Towns will participate and then the results will be forwarded to the State.  The program will offer property tax refunds to homeowners, while encouraging local governments to seek long term shared services with other municipalities where possible.

Town of Hartland Participation in Countywide Government Efficiency Plan

RESOLUTION 79-2015

WHEREAS, Governor Andrew Cuomo and the New York State Legislature enacted the Property Tax Freeze Credit to provide property tax refunds to homeowners as part of the 2014-2015 State Budget; and

WHEREAS, the new law encourages local governments to generate long-term tax relief for taxpayers by sharing services, consolidating or merging, and demonstrating and implementing operational efficiencies; and

WHEREAS, in year one of the program, which is 2015 for local governments, homeowners will receive the Freeze Credit if their local government stays within the property tax cap; and

WHEREAS, in year two of the program, which is 2016 for local governments, homeowners will receive the Freeze Credit for property taxes from any taxing jurisdiction in which the homeowners resides that stays within the property tax cap and puts forward a State-approved Government Efficiency Plan demonstrating savings equivalent to one percent of their property tax levies in each of the following three years; and

WHEREAS, while local governments may take a variety of approaches to develop their Government Efficiency Plans, the State has strongly encouraged they convene and facilitate a process to develop and submit county-wide Government Efficiency Plans; and

WHEREAS, Niagara County has offered to coordinate the development of such Government Efficiency Plans as ‘lead agency' on behalf of all other interested municipalities; and

WHEREAS, the Town of Hartland is interested in intergovernmental cooperation with Niagara County and other municipalities in submitting a county-wide Government Efficiency Plan and desires to memorialize its intention to participate in a coordinated Plan to allow its homeowners to receive the Freeze Credit.

NOW, THEREFORE, BE IT RESOLVED that the Town of Hartland seeks to ensure that Town homeowners will receive the Freeze Credit as part of this new State law; and

BE IT FURTHER RESOLVED that the Town of Hartland did not exceed its designated property tax cap for fiscal year 2015 and memorializes that it has no intention of exceeding the cap for fiscal year 2016, which if exceeded would disqualify the Town from participation in the Property Tax Cap Freeze Credit Program; and

BE IT FURTHER RESOLVED that the Hartland Town Board does hereby express its support for, and participation in a Niagara County-wide Government Efficiency Plan; and

BE IT FURTHER RESOLVED that Town Board urges the New York State Division of the Budget to approve Niagara County's coordinated Government Efficiency Plan with local governments with the understanding that Town of Hartland has played an active role in the identification of preexisting and implementation of new shared services, consolidations or merges, and operational efficiencies within the Town of Hartland for inclusion in the county-wide plan; and

BE IT FURTHER RESOLVED that certified copies of this resolution shall be forwarded to the Niagara County Manager; the Niagara County Budget Director; and the Niagara County Legislature.

MOTION by Councilman Gross, seconded by Councilman Hill to participate in the Countywide Government Efficiency Plan.

New York Retirement requires that new positions within the retirement system report a record of activities for the first 90 days upon taking office.  A local resolution to determine established standard work day is to be made and posted.

RESOLUTION 80-2015

April 9, 2015

MOTION by Councilman Gross, seconded Councilman Snyder to approve the following resolution:

BE IT RESOLVED, that the Town of Hartland hereby establishes the following as standard work days for appointed official, Joanne Sullivan, and will report the following days worked to the New York State and Local Employees' Retirement system based on the record of activities maintained and submitted by this official to the clerk of this body; or the time and attendance records, pursuant to the Town of Hartland Employee Time-Keeping system.
